1. General

Sylvia Pass Nursery strives to provide accurate information, product descriptions and pricing on our website. While every effort is made to ensure accuracy, errors may occasionally occur. We reserve the right to correct any errors, update information or cancel orders affected by incorrect pricing or descriptions.

2. Product Availability

All plants, pots and related products are subject to availability. Due to the nature of live plants, stock levels change regularly and items may sell out before the website is updated.

If an item is unavailable after an order has been placed, we will contact you to arrange a replacement, store credit or refund.

3. Plant Variations

Plants are living products and each plant is unique. The plant you receive may differ slightly from the website photographs in size, colour, shape, fullness or maturity. These natural variations do not constitute defects.

4. Pricing

All prices are displayed in South African Rand (ZAR) and include VAT where applicable. Prices may change without prior notice.

5. Payment

Orders will only be processed once payment has been received and cleared unless otherwise agreed in writing.

6. Delivery

Delivery times are estimates and may vary depending on location, weather, courier schedules or unforeseen circumstances.

Risk passes to the customer once the order has been delivered to the supplied delivery address.

Customers are responsible for ensuring that the delivery address and contact details are correct.

7. Collections

Customers collecting orders must inspect them before leaving the nursery. Once collected, responsibility for plant care transfers to the customer.

8. Returns & Refunds

Because plants are living products, returns cannot be accepted simply because a customer changes their mind.

If you receive the wrong item or a product that arrives damaged, please notify Sylvia Pass Nursery within 24 hours of delivery and provide photographs. We will assess each case individually and, where appropriate, provide a replacement, refund or store credit in accordance with the Consumer Protection Act.

9. Plant Care

Sylvia Pass Nursery provides plant care advice in good faith. We cannot guarantee the survival or growth of plants once they leave our care, as their health depends on watering, lighting, temperature, pests and customer maintenance.

10. Workshops & Events

Workshop bookings may require full payment to secure a place.

Workshop fees may be non-refundable if cancelled within 48 hours of the event unless otherwise stated.

Should Sylvia Pass Nursery need to cancel or postpone an event, participants will be offered an alternative date or refund.

11. Gift Cards & Vouchers

Gift vouchers are not redeemable for cash and may only be used before their expiry date where applicable.

12. Intellectual Property

All website content, photographs, logos, graphics and written material remain the property of Sylvia Pass Nursery unless otherwise stated. No material may be copied or reproduced without written permission.

13. Limitation of Liability

Sylvia Pass Nursery shall not be liable for any indirect, incidental or consequential damages arising from the use of this website, products purchased or advice provided.

14. Privacy

Customer information is used only for processing orders, communication and marketing where consent has been given. Personal information is handled in accordance with South Africa’s Protection of Personal Information Act (POPIA).

15. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa
